Postcards By Email is a free service that lets you choose a postcard, write a short message on it, and have it delivered to an email address you provide. These terms are the agreement between you and us. By using the site you accept them. If you do not accept them, please do not use the site.

1. Who may use the site

You must be at least 13 years old to use Postcards By Email. If you are in the European Economic Area or the United Kingdom, you must be at least 16. By using the site you confirm that you meet the applicable age requirement and that you are legally able to enter into this agreement.

2. What the service is, and what it is not

We provide a way to send a digital postcard by email. We are a conduit for messages between people. We are not a mail carrier, a messaging platform with any expectation of privacy, a secure or confidential communications service, or a means of storing anything of value. Postcards are held for approximately thirty days and are then deleted.

Do not use this service for anything that matters legally, medically, financially, or in an emergency. Delivery is not guaranteed. Messages may be delayed, filtered as spam, lost, or never delivered at all, and we accept no responsibility for any consequence of a message arriving late, arriving altered, or not arriving.

3. Rules for using the site

You agree that you will not use Postcards By Email to do any of the following, and you accept that doing so is a breach of these terms and may also be a crime:

• Send anything unlawful, threatening, abusive, harassing, defamatory, obscene, hateful, or intended to intimidate or distress the recipient.
• Harass, stalk, or repeatedly contact someone who does not want to hear from you, including by using different email addresses to evade a block.
• Send sexual content, or any content involving or directed at a minor that is sexual, grooming in nature, or intended to isolate a child from trusted adults.
• Impersonate another person, or misrepresent who a card is from.
• Send bulk, commercial, promotional, or unsolicited messages of any kind.
• Use the service to plan, coordinate, conceal, or carry out any criminal activity, or to communicate in a way intended to evade lawful detection.
• Attempt to circumvent the sending limits, the human verification check, the blocklist, or any other technical control.
• Access the service by automated means, scrape it, or attempt to interfere with, overload, or gain unauthorised access to any part of it.
• Infringe anyone's copyright, trademark, privacy, or other rights.

You are solely responsible for every message you send and for having a good-faith basis to believe the recipient is willing to hear from you.

4. We do not monitor messages

We do not read, screen, approve, or edit messages before they are sent. Messages are automatically stripped of web addresses, email addresses, and telephone numbers, and sending is rate limited, but these are technical measures rather than review, and they are not represented as effective against any particular misuse.

Nothing in these terms creates any duty on our part to monitor content, and we do not assume one. To the fullest extent permitted by law, including Section 230 of the Communications Decency Act, we are not the publisher or speaker of any message sent through the service, and we are not liable for it.

5. Reporting, blocking and removal

Every postcard includes a way to report it and a way to stop this site from ever emailing that address again. A block is permanent and is applied to all senders. You may also write to us at abuse@postcardsbyemail.com.

We may remove any card, refuse service to anyone, or block any address or connection at any time, for any reason or no reason, without notice and without liability. We may retain records of a message and of the connection that sent it, and may disclose them to law enforcement where we believe in good faith that doing so is required by law or appropriate to prevent harm.

6. Conduct of other people

You may receive a card you did not want. We are not responsible for the conduct of anyone using the service, whether online or offline, and we do not verify the identity of senders. Any dispute between you and another user is between the two of you. To the extent permitted by law, you release us from any claim arising out of another person's conduct.

7. No warranty

The service is provided as is and as available, with all faults and without warranty of any kind, whether express, implied, or statutory. We specifically disclaim any implied warranty of merchantability, fitness for a particular purpose, accuracy, quiet enjoyment, and non-infringement. We do not warrant that the service will be available, uninterrupted, secure, error free, or that any message will be delivered.

8. Limitation of liability

To the fullest extent permitted by law, we will not be liable to you for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or reputation, arising out of or relating to your use of the service, whether based in contract, tort, negligence, strict liability, or any other theory, and whether or not we have been advised of the possibility of such damages.

Our total aggregate liability to you for all claims relating to the service will not exceed the greater of the total amount you have paid us in the twelve months before the claim arose, or twenty-five United States dollars. You acknowledge that the service is provided free of charge and that this limitation is a reasonable allocation of risk without which the service would not be offered.

Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you. In that case our liability is limited to the smallest amount permitted by law.

9. You cover us for your own misuse

You agree to indemnify, defend, and hold harmless Postcards By Email and its owner, operator, and any contributors, from and against any claim, demand, investigation, loss, liability, damage, cost, or expense, including reasonable legal fees, arising out of or relating to your use of the service, any message you send, your breach of these terms, or your violation of any law or of anyone's rights.

10. Intellectual property

All postcard artwork, text, design, and code on this site belong to us and may not be copied, redistributed, resold, or used to train any model without permission. Sending a card gives the recipient the right to view it. It gives nobody the right to reuse the artwork.

If you believe material on this site infringes your copyright, write to abuse@postcardsbyemail.com with enough detail to identify the work and the material in question, and we will respond promptly.

11. Suspension and termination

We may change, suspend, limit, or discontinue the service, in whole or in part, at any time and without notice. We may do so permanently. Because the service is free, we will have no liability to you for doing so.

12. Governing law and disputes

These terms are governed by the laws of the State of Washington, United States, without regard to its conflict of law rules. You and we agree that any dispute will be resolved exclusively in the state or federal courts located in Washington State, and you consent to their jurisdiction.

You and we each agree to bring any claim only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

Any claim arising out of the service must be brought within one year after it arises, or it is permanently barred.

13. Changes to these terms

We may update these terms. The date at the top will change when we do. Continuing to use the service after a change means you accept the updated terms.

14. Everything else

If any part of these terms is found unenforceable, the rest stays in force. Our failure to enforce any part is not a waiver of it. These terms are the entire agreement between you and us about the service.
